OhhhKaye is a small sole trading business and like any business OhhhKaye will need to gather information from clients from time to time. This page explains what information/personal data OhhhKaye collects from you and how it used and stored.

Information OhhhKaye Collects

OhhhKaye will request some personal data from you once we enter business together. This data can be taken via Email or via the Telephone.

The information OhhhKaye collects and retains on file are:

Your Full Name
Your Company Name
Your/Company Postal Address
Your Email Address
Your Phone Number/Extension Number
Your Web Address

This data is collected and stored in a form of a spreadsheet that is stored on an encrypted flash drive with OhhhKaye. These details are also saved within my third party invoicing system provided by SAGE.

OhhhKaye does not collect any Sensitive Data about you or your company. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data.

OhhhKaye does not collect any information about criminal convictions and offences.

If the client wishes OhhhKaye to access any third party accounts the their behalf, such as website hosts, domain host, email providers etc. the passwords provided by the client are stored on an encrypted flash drive for only for the amount of time that the service requested by the client is undertaken. Once the job has been concluded, OhhhKaye destroys all passwords from written or digital records and does not store any of this data.

OhhhKaye holds no client banking details, payment or card details. All payments to OhhhKaye are via invoice.

Information Sharing and Disclosure

Your personal data information is only ever used to administer your requested services with OhhhKaye, invoicing and the sending of an OPT IN Mailing List with OhhhKaye.

OhhhKaye promises to provide you with only the products/services you request and nothing else.

OhhhKaye relys on a number of legal bases to collect, use, and share your information, including:

as needed to provide the OhhhKaye services you request, such as when OhhhKaye use your information to fulfil your brief, provide a service, create invoices, to settle disputes, or to provide customer support;
when you have provided your affirmative consent either written or verbal, which you may revoke at any time, such as by signing up for the OhhhKaye Newsletter/Mailing list at www.ohhhkaye.co.uk or becoming a client, in lines with my Terms and Conditions;
if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. OhhhKaye use your information to provide the services you requested and in OhhhKaye legitimate interest to improve services.

OhhhKaye may collect, use, retain, and share your information if OhhhKaye have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Third Parties

OhhhKaye can sometimes engage certain trusted third parties to perform functions and provide services, such as delivery companies, printers and website companies providing services such as SEO. OhhhKaye will share some your personal information with these third parties, but only to the extent necessary to perform these services.

For Example: If postage of printed materials is to go directly to the client (on the clients request) from a third party printer, OhhhKaye will supply your Name/Company Name and Postal Address to the third party.

OhhhKaye also holds 3 online shops with third parties (Society6, Redbubble and Etsy) and one event booking site (Eventbright).

Redbubble OhhhKaye has no access to any of the customers personal data from this website, nor does not hold any personal data on file. Purchases from this store are handle by Redbubble directly. The only data OhhhKaye can access is:

Order Date / Ship Date / The Works Name / Order Number / #Product Fulfillment / Country Destination / State Status / Qty / Retail Price*

Society6 OhhhKaye has no access to any of the customers personal data from this website, nor does not hold any personal data on file. Purchases from this store are handle by Society6 directly. The only data OhhhKaye can access is:

Etsy To fulfil your order through Etsy you, the customer, must provide OhhhKaye Etsy Store with certain information (which you authorised Etsy to provide by shopping at the store), such as:

Your name
Email address
Postal address (for non digital downloads),
Method of Payment information - No banking details.
Details of the product that you’re ordering
You may also choose to provide OhhhKaye Etsy Store with additional personal information (for a custom orders of wedding stationary for example), if you contact OhhhKaye Etsy Store directly

Eventbright OhhhKaye has no access to any of the customers personal data from this website, nor does not hold any personal data on file. Purchases from this store are handle by Eventbright directly. The only data OhhhKaye can access is:

Data Retention

OhhhKaye can retain your personal information only for as long as necessary to provide you with OhhhKaye services and as described in this Privacy Policy. However, OhhhKaye may also be required to retain this information to comply with legal, tax and regulatory obligations, to resolve disputes, and to enforce agreements.

OhhhKaye generally keeps your data for the following time period: 6 years.

Transfers of Personal Information Outside the EU

OhhhKaye may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, OhhhKaye may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If OhhhKaye deemed to transfer information about you outside of the EU, OhhhKaye relies on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.

Your Rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases.

Change, restrict, delete. You may also have rights to change, restrict OhhhKaye use of, or delete your personal information. Absent exceptional circumstances (like where OhhhKaye am required to store data for legal reasons) OhhhKaye will generally delete your personal information upon request. OhhhKaye will act on withdrawals of consent or requests to see what data OhhhKaye holds within 30 days.
Object. You can object to (i) OhhhKaye processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from OhhhKaye after providing your express consent to receive them. In such cases, OhhhKaye will delete your personal information unless OhhhKaye have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
Complain. If you reside in the EU and wish to raise a concern about OhhhKaye use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

OhhhKaye promises never to sell any of your personal data on to any other parties nor sign you up to unwanted newsletters or lists.

OhhhKaye does not call/text/post any promotional materials to exsisting clients. However a newsletter is issued 4 times a year which you may withdrawal from at ant point.

Withdrawal

OhhhKaye will make it easy for individuals to withdraw their consent for OhhhKaye hold any or all of their data at any time and publicise how to do.

OhhhKaye will not penalise individuals who wish to withdraw consent.

OhhhKaye would only contact you via Newsletter format, which will have an OPT OUT link at the bottom of every letter if you no longer wish to receive these updates and you are free to OPT OUT at any point.
